"the factor" begins right now. hi. i'm bill o'reilly! thanks for watching us tonight. is the federal government hurting or helping working americans? that is the subject of this evening's talking points memo. even though there was good economic news today, which lou dobbs will analyze shortly, the key indicator of economic strength in america, wages, remains flat. this year, the average hourly wage in this country has increased by just 2%. many economists believe because there aae not enough jobs, workers have to take less pay. seems to make sense. president obama, though, he believes that the federal government can change that situation. however, in five years, his theory has not produced results.

nevertheless, the president remains undaunted. >> we need to set aside the belief that government cannot do anything about reducing inequality. it's true that government cannot prevent all of the downsides of the technological change and global competition that are out there right now, but we've also seen how government action time and again can make an enormous difference in increasing opportunity and bolstering ladders into the middle class. >> an enormous difference? i haven't seen it, have you? maybe he's talking about fdr's new deal or social security or something like that, but presently? big government and high taxation seem to be holding back the private sector and job creation. and the left seems to want it that way. yesterday, "the new york times" editorialized, "the emphasis on cutting taxes and spending that began in the reagan years is a direct result of economic insecurity now.

it has led, for spm, to education cuts that have harmed children in low-income school districts. reversing those decisions can still have an enormous impact." but under president obama, america's spending more money on education than any other nation in the world. also, taxes have been going up. and we have record debt. but the left wants more spending and even higher taxes. simply put, the big government spending machine has not helped the economy very much. but again, liberal theory trumps results. >> the idea that so many children are born into poverty in the wealthiest nation on earth is heartbreaking enough, but the idea that a child may never be able to escape that poverty because she lacks a decent education or health care or a community that views her future as their own? that should offend all of us. >> well, it certainly offends me. if children are not getting a good education or do not have

proper health care, i'm offended. but you cannot bankrupt the entire nation on some ideological quest for income equality. in a capitalistic system, that's impossible. a "wall street journal" editorial yesterday was blunt -- "mr. obama returned to his favorite theme of rising income inequality. he ought to know since few presidents have done more to increase inequality than he has. median household income has fallen since the economic recovery began, while the rich who own capital assets have done very well." now, two things. first, the reason there is such a wide gap between the rich and the poor in america is technology. we're living in a time where people who have tech skills will make money, and people who have few skills will struggle. and the president's nanny state mentality's not going to change

that. second, american children must master skills in school. but president obama has done very little to reform the teachers unions to encourage discipline in the public schools and to be blunt about why some kids fail. the primary reason children do not learn is that their parents are chaotic, apathetic or not around. it all comes back to parenting and to discipline in the public schools. money doesn't have much to do with it. when i taught high school in miami, private school, but a poor school, i had 45 kids in my class. no air conditioning. the school could barely afford chalk. yet, most of those kids learned and prospered. why? because they were forced to. president obama lives in a world of theories, not a problem-solver. he wants to throw money at everything. his big government programs are

failing, period, and that's "the memo." now for the top story tonight, reaction. joining us from los angeles, radio talk show host amy williams and dennis kucinich. where am i going wrong here, mr. kucinich? >> bill, it's not that you're wrong, it's just that you're let me give you an example. there are 50 million americans living in poverty right now. income inequality is not simply an economic or political matter, it's a moral matter, as pope francis spoke about a couple weeks ago. we need to recognize that income inequality has been built into our system, that, for example, the top 13,400 households have more yearly income than 96 million americans. we have a problem here where a system -- >> all right, so, what is your solution to that, to seize assets from the upper, to take their money away from them? >> no, no, but we have to recognize there are moral issues

here that go back -- >> okay, i'm recognizing. i'm recognizing. what's your solution to it? >> just know where it's coming from, you know. >> i know. we all understand -- >> leo xiii, the rights of workers and capital, jobs for all. >> jobs for all. what does that mean? [ everyone talking at once ] >> every able-bodied person should be able to get a job. >> okay, so, the government -- >> if the private sector isn't providing them, the publg sector has to. >> so, you would hire, the federal government, under dennis kucinich, would hire people and pay them how much? how much a year? >> a living wage. millions of people back to work. prime the pump of the economy. we need to bring an america back which is built on highways -- >> stop the theories. stop -- >> that's not theory, it's fact. >> yes, it is. so, you would guarantee everybody who wanted a job a job at a certain living wage? do you know what that wage would be? do you know? >> you could start at $12 an hour. >> all right, so you start at $12. >> rebuild america, bridges, roads, water system, sewer system. >> that would be paid for, you would have to raise taxes

enormously. >> no, you would not. the problem is, we not only need a policy for jobs, we need monetary reform, because it used to be that the government had the ability to be able to create money to meet its needs. now we have to borrow money from banks. we have to repeal the federal reserve act of 1913, reclaim the power to be able to create money and handle the needs of the nation, whether it be economic, social -- >> all right, i don't have three hours for that. we're $17 trillion in debt. i assume for your vision to give everybody a job and pay them at least $12, and it'd have to go up from there, you'd need to have a much higher system. ebony -- >> yes. >> what is your vision of income equality? what would you do to make that happen? >> absolutely, bill. i think the problem with that phrasing is people automatically think, well, redistribution. i hate the concept of income inequality. i want to talk about opportunity inequality, bill. i want to talk about access inequality, because the income inequality issue is just a by-product of a much deeper concern, which is opportunity and access, and that for me

starts in education. >> all right, so you want more opportunity for whom? for whom? >> for everyone, but particularly -- >> everyone? >> i'll speak about people that are disproportionately affected by a depressed job market, bill. i'm talking about young, urban men, i'm talking about still women, absolutely. >> all right, let's talk about young, urban men. >> absolutely. >> all right? so, they don't have as much opportunity as whooite people w are educated, obviously. >> obviously. >> because they can't do the job. >> it's a skill set gap, absolutely. >> so, how do you close that? how? >> i think that we need to be much more specific and comprehensive, bill when we talk about education reform. i would agree with something in your talking point when you talked about throwing money at the problem doesn't fix it. i am a progressive, i am all about compassion -- >> give me one way that you close the skill set gap. how? >> we talk about changetion the curriculums in schools. we don't need kids just going to classes just for the sake of being in school. we need kids learning skill sets that can be marketable in our, as you said, throwing --

"lose a boss" segment tonight. unemployment's dropped from 7.3% to 7%. good news for the country. in other economic developments, more than 4 million americans have been out of work more than four months, more than 11 million are looking for jobs and wages are stagnant. here to put it in perspective, fox business anchor lou dobbs.

so, the jobs situation's getting better? >> absolutely, it is getting better. it's slow, it's incremental. it's barely better than a year ago, but it is better, and we're seeing -- >> is it better because of christmas, though? is that what this november number is? >> no, no. >> people hire for christmas. >> no, because what we're seeing, bill, over the last three years, we are seeing a steady increase, and i'm talking about 5,000 jobs a month, just about, improvement in job creation. >> what kind of jobs are they? >> we're talking now about manufacturing jobs coming back as well as services. >> and why is this happening? >> it's happening because fundamentally, this is still an extraordinarily resilient economy. >> all right, so, some people are making money and they're moving stuff and they need people to either make it or put it out there. >> and it certainly hasn't hurt that the federal reserve, some might argue that it has hurt, but i would not be among those -- >> kucinich just did. >> i know. >> they're creating a lot of money and there's a lot of equity around and you can borrow easy. okay, let's get into the -- >> that's what i was going to

reform as far as teacher productivity is concerned. >> so, you don't want to engage in educational theory, you actually want him to do something. >> yeah, i want everybody to do something. >> absolutely. >> because all their solution is, "the new york times," too, throw money at -- bang! here! more money. and the money doesn't do anything but raise taxes. >> two things people don't have the guts to deal with in this, and i'm talking about both parties -- they don't have the guts to say to the unions, our lined against local school districts for education, we're going to end it. we also have to have discipline in the classroom. and as you pointed out in your talking points and have pointed out a number of times on your broadcast, we've got to restore respect for the teacher, for the system and make sure -- >> every public school kid in the country should wear a uniform, number one. that will send a message. >> i think it's great idea. >> but here, i want everybody to consider this, catholic schools are everywhere, all right? the education you get in catholic schools, generally speaking, is much better than the education you get in public

schools. yet, catholic school teachers make less money. >> right. >> because they're not unionized. in d.c., when they had the voucher system, where did all the poor people go? catholic school. that's where they ran into. why? because there is discipline in a catholic school. >> right. >> there's standards in the catholic school. you can't curse at the teacher in a catholic school. you can't create pandemonium in that school. but you can in the public school. last word. >> well, you know, my generation out west, we had a uniform, a t-shirt and a pair of blue jeans, and just about everybody wore it. not a big problem. this crazy idea that we have to somehow bow down to unions, a public employee union, and give away the control of an educational system that's been the treasure of the world is to me mindless. >> we spend more money than any other country on earth on education, and obviously, the kids' test scores can't compete with south korea and other countries. >> absolutely. >> all right, lou dobbs,

"factor follow-up" segment. even though many americans deny there's a war on christmas, there is one. every year, we see attempts to ban christmas delays and even the word christmas in some

cases. in "the new york times," gail collins wrote "led by the american family association and fox news's bill o'reilly, conservative christians have been encouraging boycotts of stores that do not connect their aim to sell massive amounts of clothes, toys, electronics and linens over the month of december with the birth of christ." that is a snide comment, is it not? it's also false. the only time we get involved with stores is if they forbid their employees to say merry christmas, a direct violation of freedom of speech. ms. collins has misled her viewers and readers before, and the editors of the "the new york times" don't seem to mind. we asked the woman to appear this evening, but she is hiding under her desk. joining us now from boston, chris stedman, assistant humanist chaplain at harvard university and author of the book "fatheist, how atheists found common ground." i want your opinion on the massive display in times square

put up by the american atheist group, which says "who needs christ during christmas? nobody." it's kind of mean-spirited, is it not? >> well, i'm going to go out on a limb here, bill, and say that i do not think that the number one issue facing atheists in the united states today is christians celebrating christmas, right? i think we have much bigger concerns. in my mind, one of those biggest concerns, if not the biggest, is that atheists, according to a number of surveys, are widely distrusted in the united states, perhaps more so than just about any other group, and i do not see these billboards as contributing to the destigmatization of atheists -- [ everyone talking at once ] >> but i want you to explain to the audience the mentality. i'm a simple man, even though i attended harvard. they're embarrassed that i actually got in there. just leave christmas alone. just leave it alone, okay? it has nothing to do with you. you're an atheist. you don't believe in jesus, you

don't believe in any of that, but you do get the day off. have fun, all right, go ice skating. leave it alone for the people who revere it. i don't understand why they just don't have that philosophy. >> well, on some level, i somewhat understand what some of the concerns are, mostly because this is a society where christians do benefit from a level of religious privilege. now, does that mean that these billboards are a good strategy in addressing that? no, i don't think so. i would much rather see a billboard saying do you not celebrate christmas? you're not alone. or do you celebrate christmas without believing in christ? you're not alone. instead of saying who needs christ in christmas, nobody. >> okay, but why are some atheists -- and there are groups, entire groups devoted to suing schools that might have the timert of letting kids sing a christmas carol. i mean, someone. why? are they that bitter against religion? is that what it is? did they have a bad experience

with organized religion? is it bitterness? >> well, i don't want to psycho analyze atheist activists who do prioritize that, but what i will say is that i think that the separation of church and state is in place to insure that the government does not privilege one religion over any other. it does not endorse any one religion over any other. so, my feeling on christmas displays in public spaces, in public schools is that if those are there, there should be displays for many different religions and many nonreligious -- >> i don't think many people have a beef with that. i don't think -- not in my crew. >> no -- >> nobody has a beef with that. >> i would hope not, yeah. yeah, exactly. >> i mean, we don't like, we don't like -- >> i mean, look -- >> i have to amend this. there are two things that have come up, one in the capital of washington state, in olympia. there were some atheist groups who said if you have a christmas tree, i'm going to put up an obnoxious sign saying all

believers are morons or something like that. now, that's not in the spirit of anything. if they want to put up a sign saying, just what you said, if you don't believe in christmas, you're not alone, contact ziggy and here's his phone number. that's fine. i don't bother that. the second thing is macy's -- >> yeah, i mean -- >> macy's brought in santa claus, st. nicholas, okay? but refused to say what holiday st. nicholas was being brought in for. i just thought that was absurd and i mocked them, all right? however, what i'm seeing here is an amazing amount of anger, not from you, because you're a humanist chaplain, all right? you can't be angry. you have to be nice. but from other atheists that are just so angry, and i don't really know what they're angry about. >> well, you know, i completely agr agree, in terms of, when it comes to these public displays, i would much rather see a lot more of the yes of atheism and humanism in the public square than the no of atheism. i want to hear from atheists

news anchor geraldo rivera. how do you see the case? >> first of all, winston will never sue for deformatier defam what i would urge voters for the heisman trophy, voting is scheduled for monday, they should read the police incident report in this case. this is not -- let me tell you what this is not, bill. this is not a case of some woman years after the fact conjuring up a set of circumstances and said, oh, three years ago, so-and-so did something to me, even though this happened almost exactly one year ago. it will be one year ago tomorrow. this woman filed this case contemporaneously. she filed it almost immediately. she began complaining to her friends that she had been at a bar, some men had encouraged her, she had taken five vodka shots, to come to winston's apartment. she didn't know who it was. she got there, he wasn't even at the bar. these men brought her to him, a star athlete who was a baseball player, he was the number one recruit.

he wasn't yet the heisman candidate that he became when florida state, the seminoles, made this amazing run that they've made this year to be the number one team in the nation, but he was a big man on campus. she was brought to him. she alleges in the incident report that he began assaulting her. she was fighting him off. the roommate, winston's roommate came to the door, said, a guy named chris, came to the door, says, "hey, man, cool it." then he took her, allegedly, winston took her into the bathroom where he finished the act. >> okay, was there any physical evidence? did she go to the hospital? was there physical evidence? >> say in the incident report, and that's why the laughter that you saw from the state's attorney, miggs there, should choke in your throat, because she was bruised up. according to the cop who interviewed her immediately after -- >> was there any medical log? >> it says in incident report,

the cop with his eyes sees the bruises on her elbows and knees. >> the police, but no hospital report, which would have been crucial. >> no, there is dna. there was definitely sex between these two people. >> what she ayes -- yeah, but that's his defense is that it was consensual. now, if what you're saying is true, and the police officer, you know, after the fact saw this, then it's incumbent on the state of florida to prosecute it, is it not? >> i would suggest -- i would submit that if this was some other nobody, the cops would have responded, in some other town, the cops would have responded far differently. but in this case specifically, this complainant and her family and attorney allege that the officer investigating said to her, you know this is a football crazy town, tallahassee, florida, the state capital where fsu is located. you're going to have a very tough time if you file these charges. jump cut, that's back in january, jump cut to november when the file, the charges become more public, and look

what's happened to this woman. she's been widely ridiculed. they make a big part of the fact that she had sex had we are boyfriend the same night that she went to the bar and got picked up and taken to the apartment of james winston. you know, this -- and she's dropped out of school as a result. so, exactly what the cop said in january has come true. bill, this is an outrage. i'm telling you. and miggs, that state attorney, an fsu grad and undergraduate and an fsu grad in law school, a big booster of the seminoles? come on, this is an old boys network. and what happened to that woman is outrageous! i'm telling you, this is something -- this is football, not just -- >> if this ever happens to anybody or anybody's daughter or anybody, anything like that, go to the hospital, go to the hospital. that's the advice. get examined, because -- >> oh, she did have a rape kit. she had a rape kit. the interview first, then the rape kit, so eventually, they did. so, there is great documentary evidence.

we know she had sex with that guy that night -- >> right, we just don't know it it was forced all right, another situation involving football players, the university of north carolina. we only have 90 seconds. a professor has been charged with a felony for doing what? >> he created a class. the chairman of the department of afro studies and african-american studies created a class, a lecture series attended by 18 of the university of north carolina at chapel hill football players and a retired football player. they came to his class. there was no class. the class never took place! he gave them great grades. there is computer evidence that the grades were jury-rigged to fit the specific needs of the football players -- >> so, they never had to go to the class, do any assignments. >> nothing, zero, zero, zero. it was a no-show class, they created it. >> and the state of north carolina has charged this guy, right? >> now the professor has been indicted, is facing 30 months in jail. that won't happen, he'll get probation. but the worst thing that happened is this fine university has been number summerched,

>> $7.25. >> so, they want double minimum wage more i guess from mcdonald's, burger king, taco bell. would you give it to them, gutfeld? >> i will tell you why. if you dramatically raise minimum wage, say you're doubling it, what happens to all the other -- >> everything goes up. >> yes. so, to keep the pay structure sound, you've got to move everything up, which then makes everything more expensive, and ultimately, you lose jobs. >> but wouldn't you be paying more for a whopper so they could have more money? >> the greatest thing to ever make fast food. >> i would pay more for fast food, but i have it. so, there are a lot of people who depend on inexpensive food. >> it actually affects the people they claim to help. by the way, how many of those protesters are actually protesters? a lot of union groups, they bus people in and you never know if they actually work at fast-food restaurants or anywhere. and has this had any effect at all? i don't know. >> here's the solution to this problem. once again, o'reilly has the solution. in every fast-food place, there should be a big display for tips. >> ah. >> for tips. >> good idea.
